1. Copyright & Licensing
All photographs and media produced by Joseph Ryan Photography remain the exclusive property and copyright of Joseph Ryan Photography. Clients are granted a non-exclusive, non-transferable limited license to use the media as follows:

Property Listing License: This license is for the marketing of a specific property listing.

 -Standard Media: Includes a 6-month limited license.

 -Video Bundles & 3D Bundles: Include a 1-year limited license.

 -We do offer unlimited equal ownership licensing that can be purchased with no expiration.  Please reach out to discuss this and get a quote. 

 -License Extensions via Updates: If Joseph Ryan Photography performs any "go-back" or update work, the license for all project media will reset and extend for a full new term (6 months or 1 year, based on the original package) from the new delivery date.

 

 -Self-Marketing Perpetual License: Notwithstanding the listing expiration, the original client/agent may use any photos or video to market themselves or their immediate team only (e.g., social media highlights, personal websites, or "sold" portfolios) indefinitely. No license update or additional fee is required for this specific use.

 -Restrictions: Media may not be sold, transferred, or gifted to third parties (such as other agents, staging companies, or contractors) for different projects without explicit written consent from Joseph Ryan Photography.

 -Media may not be sold, transferred, or gifted to third parties or used on different projects without explicit written consent. If you need to extend a license beyond its original term without booking update work, please contact us to discuss pricing. 

 

 

 

2. Payment Terms
We do not require an upfront deposit to book a session. However, full payment is required prior to downloading or receiving final, unwatermarked deliverables.

 -Standard Payment: We accept payment through our website or via previously agreed-upon methods.

 -Late Fees: If an alternative payment arrangement has been agreed upon, payment is due within 24 hours of delivery. Any balance remaining unpaid 7 days after the delivery date will incur a $25.00 late fee. 

 

 

 

3. Cancellation & Rescheduling Policy
Please notify us as soon as possible if you need to change your appointment.

 -48+ Hours Notice: No penalty.

 -Next-Day Cancellation: Cancellations made the calendar day prior to the scheduled appointment will incur a $50.00 fee, regardless of the time of day the cancellation occurs.

 -Same-Day Cancellation: $100.00 cancellation fee.

 -No-Show / No Access: If our photographer arrives on-site and cannot access the property, a fee of 50% of the total order cost (minimum $100.00) plus applicable travel/weekend fees will apply.

 

4. Property Readiness & "As-Is" Policy
To ensure the highest quality results and stay on schedule for all clients, we require properties to be camera-ready upon our arrival.

 -"As-Is" Condition: Properties are photographed in their existing condition. Joseph Ryan Photography is not responsible for cleaning, dusting, moving furniture, or clearing clutter. We do not provide staging services.

 -Photographer Discretion: The photographer will not be held responsible for items left in the shot (e.g., trash cans, pet bowls, vehicles in the driveway) that were present at the time of the session.

 -Arrival Grace Period: We provide a 15-minute grace period for minor, last-minute adjustments.

 -Unready Property Fee: If the property is not ready after 15 minutes, the appointment must be rescheduled and will be billed as a Same Day Cancellation, and the fees associated with it, $100.00

 -Extended Wait Time: If our schedule permits us to wait longer than 15 minutes at your request, a $50.00 Delay Fee will be added to the invoice for every 30 minutes of waiting time.

5. Rescheduling Policy
If you need to reschedule a scheduled photography session, please let us know as soon as possible. We will do our best to accommodate your request, but we cannot guarantee availability. 

 

 

 

6. Delivery Policy
Standard Delivery: Photos and Matterport tours are delivered by 10:00 p.m. the following business day. Video tours are delivered within three (3) days of the appointment.

 

 -Rush Delivery: For a $50.00 fee, we guarantee delivery by 10:00 a.m. the following day (including weekends/holidays).

 

 -Delays: If we anticipate missing a deadline, we will contact you in advance to discuss alternative arrangements.

 

 

 

7. Liability Release

Joseph Ryan Photography will not be held responsible for any injuries, damages, or losses that occur during a photography session. By using our services, you agree to release us from any liability related to the photography session.

 

 

 

8. Ownership

All content included on this site is and shall continue to be the property of Joseph Ryan Photography or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement or as outlined in any separate licensing agreement you may have with Joseph Ryan Photography. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site. Should you violate this provision, we reserve the right to take legal action to protect our intellectual property.
